Class Deviation from VAAR 801.602-3 Ratification of Unauthorized Commitments

Purpose:  To announce the issuance of a class deviation to the VAAR 801.602-3(b)(1)(2)(3)(i)(ii)(iii):  (1) changed the ratification authority from the Deputy Assistant Secretary (DAS) for Acquisition and Materiel Management to the Head of Contracting Activities (HCAs), (2) to delegate, without further re-delegation, to the HCAs the authority to ratify all unauthorized commitments in accordance with FAR 1.602-3(b)(2); and (3) to rescind ratification authority from the “chief financial officers of the Administrations” as presently delineated in VAAR 801.602-3(b)(2).

Effective Date:  Immediately

Expiration Date:  Effective until incorporated into the revised VAAR and VAAM.

Background:  On April 16, 2012, a class deviation from the VA Acquisition Regulation (VAAR) Part 801.304 was issued due to organizational and procurement functions realignment.  This organizational realignment conflicts with the VAAR 801.602-3 Ratification of unauthorized commitments, as presently written, since organizational titles and positions have changed.  Therefore, it became necessary to issue a class deviation to the VAAR 801.602-3.

Head of Contracting Activity (HCA):  In accordance with FAR 1.404 and VA Acquisition Regulation (VAAR) 801.404, the DSPE issued a class deviation to the VAAR 801.602-3(b)(1)(2)(3)(i)(ii)(iii), which delegates, without further re-delegation, to the HCAs the authority to ratify all unauthorized commitments in accordance with FAR 1.602-3(b)(2).

Action Required:  HCAs to comply with and ensure dissemination of the class deviation to the VAAR 801.602-3(b)(1)(2)(3)(i)(ii)(iii).
