EXECUTIVE ORDER 13160
NON-DISCRIMINATION ON THE BASIS OF RACE, SEX, COLOR, NATIONAL ORIGIN, DISABILITY, RELIGION, AGE, SEXUAL ORIENTATION, AND STATUS AS A PARENT IN
FEDERALLY CONDUCTED EDUCATION AND TRAINING PROGRAMS

On June 23, 2000, President Clinton issued Executive Order 13160 entitled "Non-discrimination on the Basis of Race, Sex, Color, National Origin, Disability, Religion, Age, Sexual Orientation, and Status as a Parent in Federally Conducted Education and Training Programs." The Executive Order directs all Federal agencies that conduct education and training programs to commit themselves to providing educational environments that are free of discrimination on the basis of race, sex, color, national origin, disability, religion, age, sexual orientation, and status as a parent. The Department of Justice requires each Federal agency to establish procedures for receiving and addressing allegations of discrimination on these bases.
- Complaint Procedures - In accordance with this Executive Order, employees may file complaints under Title VII or the Executive Order itself.
- Complaints under Title VII - Individuals filing complaints under Title VII will follow the procedures established under Title 29, sect. 1614 for processing EEO complaints (Traditional EEO complaint process, see ORM "EEO Discrimination Complaints Process" pamphlet).
- Complaints under Executive Order 13160 - Employees opting to use Executive Order 13160 to file a complaint will be given 180 days from the date of occurrence or incident of discrimination to file a claim. The complainant will enter the complaint process by filing a formal written complaint with the Office of Policy and Compliance, Office of Resolution Management, 810 Vermont Avenue NW, Washington, DC 20420. Upon receipt of a complaint, the Office of Policy and Compliance will conduct a procedural determination. If acceptable, an investigation of the complaint will be conducted and the appropriate remedy allowed under this Executive Order applied, based on the facts and circumstances of the case. If unacceptable, the Chief, Policy and Compliance will render the final agency decision and the Deputy Assistant Secretary for Resolution Management will hear the appeal.
