What's Changed?

Class Deviation from FAR 6.304, Approval of Justification

Purpose:  To advise the VA Acquisition Workforce of Class Deviation from VAAR 806.304 Approval of the Justification.  This class deviation deletes VAAR 806.304(a) including Table 806.304-1 and updates VAAR 806.304(b) to reflect threshold change from $50 million to the FAR threshold in 6.304(a)(3).

Federal Acquisition Regulation (FAR) and Veterans Affairs Acquisition Regulation (VAAR) Sections Impacted:  FAR 6.304, VAAR 806.304.

Effective Date:  Immediately

Expiration Date:  Until incorporated into the Veterans Affairs Acquisition Regulation (VAAR) or Veterans Affairs Acquisition Manual (VAAM) or otherwise rescinded.

Background:  Thresholds for approval of justifications for other than full and open competition in the FAR have increased several times in the past years.  Therefore, VAAR 806.304 as revised via a class deviation dated 27 December 2012 is not current.

Applicability:  Applies to proposed contracts using other than full and open competition.

Action Required:  Effective immediately, contracting officers shall comply with FAR 6.304 for approval of justifications for sole source awards.
