Guidance to the Acquisition Workforce Regarding Ordering Officer Appointments to Non-Warranted Personnel

Purpose:  This Acquisition Flash provides the following information and guidance:

The Deputy General Counsel for Legal Policy (02LP) has determined that neither Federal Acquisition Regulation guidance nor fiscal law prohibits contracting officers from delegating authority to non-warranted individuals to place “funded delivery orders” or obligate funds on delivery orders against indefinite delivery contracts and negotiated Federal Supply Schedule blanket purchase agreements, where the terms and pricing are established and no further competition is required.  The contracting officer’s contract administration responsibilities may not be delegated.  Contracting officers remain responsible the administration of the contract actions, including all actions performed by non-warranted individuals appointed as ordering officers.  As such, contracting officers must carefully enumerate and consider all contracting officer responsibilities, prior to delegation of ordering officer authority to non-warranted individuals.  Procedures for delegating ordering officers are found in the VA Procurement Policy Memorandum (2016-02)–VA-Wide Procedures Regarding the Use of Ordering Officers.

Background:  This Acquisition Flash notifies the acquisition workforce of the ability for contracting officers to delegate ordering officer authority to non-warranted individuals, but remain responsible for all administration of the contracts, including all actions performed by appointed ordering officers to non-warranted individuals.

Applicability:  This notification is directed to the VA acquisition workforce.
