What's Changed?

Notification of the Publication of Revised Department of Veterans Affairs Acquisition Regulation (VAAR) Parts 815, Contracting by Negotiation, 837, Service Contracting, and affected parts 801, 816, 849, 852, and 871

Purpose:  To notify the VA Acquisition workforce of the publication of revised VAAR parts 815, 837 and their affected parts 801, 816, 849, 852, and 871; as well as the publication of new VAAM parts M815 and M837.

VAAR/VAAM Parts Impacted:  VAAR parts 801, 816, 837, 849, 852, and 871; and VAAM parts M815 and M837.

Effective Date:  October 4, 2019.

Background:  In order to enhance the department level guidance for all VA acquisitions, VAAR Update Number 2008-19 dated October 4, 2019, contains revisions to VAAR parts 815, Contracting by Negotiation, 837, Service Contracting, and affected parts 801, 816, 849, 852, and 871 that were published in a Federal Register Notice as a final rule at 84 FR 46448 (document number 2019-17824) on September 4, 2019 with an effective date of October 4, 2019, and which adopted as a final rule the proposed rule published September 7, 2018.

Due to the publishing of new VAAR part 815, the following VA acquisition policies are superseded:

  1. Class Deviation from VA Acquisition Regulation (VAAR) 815.303 – Responsibilities, dated December 15, 2016, and its associated Acquisition Policy Flash! 17-12;
  2. Class Deviation–Implementation of the Veterans First Contracting Program as a Result of the U.S. Supreme Court Decision (Class Deviation—Veterans First Contracting Program (VFCP)), dated July 25, 2016, provision at 852.215-70 only, on Attachment 10.

Applicability:  This notification is directed to the VA acquisition workforce.

Action Required:  Comply with the requirements of the abovementioned revised and affected VAAR parts, and new VAAM parts.
