What's Changed?

Notification of VA Acquisition Regulation (VAAR) Update Number 2008-23

Purpose: To notify the VA acquisition workforce of the publication of revised VAAR parts 804, 805, 849, and their affected part 852; as well as the publication of new VAAM parts M805 and M849.

Affected VAAR/VAAM Parts: VAAR parts 804, 805, 849, and 852; and VAAM parts M805, and M849.

Applicability: This notification is directed to the VA acquisition workforce.

Background: VAAR Update Number 2008-23 dated July 16, 2020 contains revisions to VAAR parts 804, 805, 849, and their affected part 852 that were published in a Federal Register Notice as a final rule at 85 FR 36348 (document number 2020-11608) on June 16, 2020 with an effective date of July 16, 2020, and which adopted as a final rule the proposed rule published February 13, 2020. Due to the publishing of revised VAAR parts 804, 805, 849, and their affected part 852; and VAAM parts M805, and M849, the following VA acquisition policies are rescinded:

  1. Class Deviation—Implementation of the Veterans First Contracting Program as a Result of the U.S. Supreme Court Decision (Class Deviation—Veterans First Contracting Program (VFCP)), dated July 25, 2016 (Acquisition Policy Flash! 16-20 attachment 2 (part 804) only is rescinded.
  2. VA Procurement Policy Memorandum (PPM) 2016-09—Rescission of the 1997 Non-codified Material (Formerly the 1997 Veterans Affairs Acquisition Regulation (VAAR)), dated September 30, 2016, Attachment 3, Part 804—Administrative Matters, and Attachment 4, Part 805—Publicizing Contract Actions, are rescinded. PPM 2016-09 is now rescinded in its entirety.
  3. VA Procurement Policy Memorandum 2019-03, Reporting Requirements for Congressional Notification of Certain Contract Actions, dated March 12, 2019, is rescinded.

Action Required: Comply with the requirements of the abovementioned revised and affected VAAR parts, and new VAAM parts.
