What's Changed?

VA Acquisition Regulation Update 2008-34

Purpose: To notify the VA acquisition workforce of the publication of revised VAAR parts 801 and 835, and their affected parts 802, 808, 816, and 852.

Affected VAAR Parts: VAAR parts 801, 802, 808, 816, 835, and 852.

Effective Date: December 21, 2022.

Background: VAAR Update Number 2008-34 dated December 21, 2022, contains revisions to VAAR parts 801, 802, 808, 816, 835, and 852 published in a Federal Register Notice as a final rule at 87 FR 70745 (document number 2022-23961) on November 21, 2022 with an effective date of December 21, 2022, and which adopted as a final rule the proposed rule published February 23, 2022. Due to the publishing of the revised VAAR parts, the following VA acquisition policies are rescinded:

  1. Class Deviation from VA Acquisition Regulation (VAAR) Part 801.603-70 - Representatives of Contracting Officers, dated 8/22/19.
  2. Class Deviation from VA Acquisition Regulation 801.690-3, 801.690-4, 801.690-6, and 801.690-7, dated 7/12/19.
  3. Class Deviation from Various VA Acquisition Regulation Sections to Update Head of Contracting Activity Delegation and Redelegation Authorities; and Increase a Threshold for Review of Acquisition Plans, dated 3/8/18. This class deviation was previously partially obsolete, however, is now rescinded in its entirety due to the rescission of the final remaining section 801.602-71.
  4. Class Deviation from VA Acquisition Regulation (VAAR) 801.602-75, Review Requirements-OGC, dated 4/12/17.
  5. Class Deviation from VA Acquisition Regulation (VAAR) 801.602-71, dated 10/6/16.
  6. Class Deviation from VA Acquisition Regulation (VAAR) 801.602-70, 801.602-71 & 801.602-72, dated 12/2/15.
  7. Class Deviation from VA Acquisition Regulation 801.603-70, Representatives of Contracting Officers, dated 11/19/14.
  8. Class Deviation from VA Acquisition Regulation 801.602-3 Ratification of Unauthorized Commitments, dated 5/3/13.
  9. Class Deviation from VA Acquisition Regulation 801.304, dated 4/16/12.

Applicability: Comply with the requirements of the abovementioned revised and affected VAAR parts.
