Citation Nr: 1244366 Decision Date: 12/31/12 Archive Date: 01/09/13 DOCKET NO. 07-07 711 ) DATE ) On appeal from the decision of the Department of Veterans Affairs Regional Office in St. Petersburg, Florida THE ISSUE Entitlement to a total disability rating based on individual unemployability due to service-connected disabilities (TDIU). REPRESENTATION Appellant represented by: The American Legion WITNESSES AT HEARING ON APPEAL Appellant and his spouse ATTORNEY FOR THE BOARD G. A. Wasik, Counsel INTRODUCTION This matter comes before the Board of Veterans' Appeals (Board) on appeal of a March 2006 rating decision by the Department of Veterans Affairs (VA) Regional Office (RO) in St. Petersburg, Florida. In December 2007, the Veteran testified at a hearing at the RO before the undersigned Veterans Law Judge. A transcript of the hearing is of record. The Board remanded the case to the Originating Agency for further development in November 2010. After the development was completed the case was returned to the Board. In May 2012, the Board remanded the issue on appeal to the RO to schedule the Veteran for another Board hearing. The RO subsequently scheduled the hearing, but prior to the date of the hearing, the Veteran, through his representative, informed VA that he desired to withdrawal his appeal. FINDINGS OF FACT 1. The Veteran in this case served on active duty from August 1990 to December 1993. 2. On July 16, 2012, prior to the promulgation of a decision in the appeal, VA received notification from the appellant, through his representative, that a withdrawal of this appeal is requested. CONCLUSION OF LAW The criteria for withdrawal of the appeal have been met. 38 U.S.C.A. § 7105(b)(2), (d)(5) (West 2002); 38 C.F.R. § 20.204 (2012). REASONS AND BASES FOR FINDINGS AND CONCLUSION The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C.A. § 7105 (West 2002). An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204 (2012). Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In the present case, the appellant, through his representative, has withdrawn this appeal and, hence, there remains no allegation of error of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal and it must be dismissed. ORDER The appeal is dismissed. Shane A. Durkin Veterans Law Judge, Board of Veterans' Appeals Department of Veterans Affairs
