Marcus, Counsel INTRODUCTION The Veteran served on active duty from May 1967 to May 1974. This matter is before the Board of Veterans' Appeals (Board) on appeal from a February 2012 rating decision of the Department of Veterans Affairs (VA) Regional Office (RO) in Huntington, West Virginia. The Veteran recently submitted a statement claiming entitlement to service connection for diabetes mellitus, type II. This issue has never been considered by the RO, is not properly before the Board here, and, therefore, is REFERRED to the RO for proper adjudication. The appeal is REMANDED to the RO via the Appeals Management Center (AMC), in Washington, DC. VA will notify the Veteran if further action is required on his part. REMAND The Veteran has a right to request a hearing before the issuance of a Board decision. Bernard v. Brown, 4 Vet. App. 384, 393 (1993) (citing 38 U.S.C.A. § 7104(a) (West 1991)); 38 C.F.R. §§ 3.103(a) and (c), 19.9, 19.25, 20.704. The Veteran requested a travel board hearing on his VA Form 9. To date, he has never been afforded a hearing. There is no indication in the claims folder that the Veteran withdrew this request. The RO must schedule the Veteran for a travel board hearing as requested. Accordingly, the case is REMANDED for the following action: The Veteran must be scheduled for a Travel Board hearing before the Board for the issue of entitlement to service connection for ischemic heart disease. The Veteran has the right to submit additional evidence and argument on the matter the Board has remanded. Kutscherousky v. West, 12 Vet. App. 369 (1999). The claim must be afforded expeditious treatment. The law requires that all claims that are remanded by the Board of Veterans' Appeals or by the United States Court of Appeals for Veterans Claims for additional development or other appropriate action must be handled in an expeditious manner.
