He died in May 2009, and the appellant is the surviving spouse. This matter is before the Board of Veterans' Appeals (Board) on appeal of a rating decision in August 2009 of a Department of Veterans Affairs (VA) Regional Office (RO). The appeal is REMANDED to the RO via the Appeals Management Center in Washington, DC. REMAND In the substantive appeal in September 2010, the Appellant requested a hearing before the Board. In June 2013, the Appellant's representative reiterated the request. As the Appellant is entitled to a hearing before the Board under 38 C.F.R. § 20.700(a), the case is REMANDED for the following action. Schedule the Appellant for an in-person hearing before the Board at the Atlanta, Georgia, RO. The Appellant has the right to submit additional evidence and argument on the matters the Board has remanded. Kutscherousky v. West, 12 Vet. App. 369 (1999). The claims must be afforded expeditious treatment.
