REPRESENTATION Appellant represented by: Disabled American Veterans ATTORNEY FOR THE BOARD R. Kessel, Counsel INTRODUCTION The Veteran served on active military duty from September 1968 to December 1971. These matters come before the Board of Veterans' Appeals (Board) on appeal from a November 2005 rating decision of the Department of Veterans Affairs (VA), Regional Office (RO), in Waco, Texas. In a May 2013 decision, the Board granted service connection for onychomycosis. At that time, the Board also remanded claims of service connection for a psychiatric disorder, scars, dental trauma, a skin disorder, and bilateral hand tremors, for additional development and consideration. This appeal was processed using the Veterans Benefits Management System (VBMS) electronic claims processing system. FINDING OF FACT In correspondence received in July 2013, prior to the promulgation of a decision by the Board, the Veteran withdrew all issues on appeal. CONCLUSION OF LAW The criteria for withdrawal of the appeal of the issues of entitlement to service connection for a psychiatric disorder, scars, dental trauma, a skin disorder, and bilateral hand tremors, have been met. 38 U.S.C.A. § 7105 (West 2002); 38 C.F.R. § 20.204 (2012). REASONS AND BASES FOR FINDING AND CONCLUSION The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C.A. § 7105(d)(5) (West 2002). An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204 (2012). Withdrawal may be made by the appellant or by his or her authorized representative. Id. In the present case, in correspondence received in July 2013, which was prior to the promulgation of a decision by the Board, the Veteran withdrew all issues on appeal. There remain no allegations of errors of fact or law for appellate consideration. The Board does not have jurisdiction to review the appeal of the issues of entitlement to service connection for a psychiatric disorder, scars, dental trauma, a skin disorder, and bilateral hand tremors; the appeal of these issues is dismissed. ORDER The appeal is dismissed. ____________________________________________ Mark D. Hindin Veterans Law Judge, Board of Veterans' Appeals Department of Veterans Affairs
