Peters, Associate Counsel INTRODUCTION The Veteran appears to have had active duty service from October 1957 to April 1958, as well as other subsequent periods of active duty for training (ACDUTRA). This matter comes before the Board of Veterans' Appeals (Board) on appeal from an April 2012 rating decision by the Department of Veterans Affairs (VA) Regional Office (RO), which denied service connection for bilateral hearing loss and tinnitus. The Veteran timely appealed that decision. Please note this appeal has been advanced on the Board's docket pursuant to 38 C.F.R. § 20.900(c) (2013). 38 U.S.C.A. § 7107(a)(2) (West 2002). The appeal is REMANDED to the RO via the Appeals Management Center (AMC), in Washington, DC. VA will notify the appellant if further action is required. REMAND In his May 2012 substantive appeal, VA Form 9, the Veteran indicated that he did not wish to have a hearing before the Board. However, in a June 2012 correspondence, he stated that he did not "ask for a hearing before, but I feel it would be best now." Based on that correspondence, the Board sent the Veteran an October 2013 letter clarifying which type of hearing he would like. In a November 2013 response, the Veteran indicated that he wished to have a hearing before a Veterans Law Judge at his local regional office. Therefore, this case should be remanded at this time in order for the Veteran to be scheduled for a hearing as he has requested. Accordingly, the case is REMANDED for the following action: (Please note, this appeal has been advanced on the Board's docket pursuant to 38 C.F.R. § 20.900(c) (2013). Expedited handling is requested.) Schedule the appellant for a hearing before a Veterans Law Judge at the RO, and notify him and his representative of the date, time and location of this hearing. Place a copy of the hearing notice letter in the claims file. If, for whatever reason, the Veteran withdraws his request for a hearing or fails to report for same please add appropriate documentation to the claims file. The appellant has the right to submit additional evidence and argument on the matters the Board has remanded. Kutscherousky v. West, 12 Vet. App. 369 (1999). This claim must be afforded expeditious treatment. The law requires that all claims that are remanded by the Board of Veterans' Appeals or by the United States Court of Appeals for Veterans Claims for additional development or other appropriate action must be handled in an expeditious manner.
