Gallagher, Associate Counsel INTRODUCTION The Veteran served on active duty from November 1984 to January 1993. This appeal is before the Board of Veterans' Appeals (Board) from a September 2008 rating decision of the Department of Veterans Affairs (VA) Regional Office (RO) in San Diego, California. Jurisdiction has since been transferred to the RO in Oakland, California. FINDING OF FACT In a December 2017 statement, prior to the promulgation of a decision in the appeal, the Veteran withdrew his appeal of the issue of entitlement to an evaluation in excess of 20 percent for hepatitis C. CONCLUSION OF LAW The criteria for withdrawal of the appeal for the issue of entitlement to an evaluation in excess of 20 percent for hepatitis C have been met. 38 U.S.C. § 7105(d)(5) (2012); 38 C.F.R. § 20.204 (2017). REASONS AND BASES FOR FINDING AND CONCLUSION The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by a veteran or by his or her authorized representative. Id. In a December 2017 statement, prior to the promulgation of a decision in the appeal, the Veteran withdrew the appeal of the issues of entitlement to an evaluation in excess of 20 percent for hepatitis C. As to this issue there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review this claim and it is dismissed. ORDER The appeal on the issue of entitlement to an evaluation in excess of 20 percent for hepatitis C has been withdrawn and is dismissed. ____________________________________________ JONATHAN B.
