REASONS FOR REMAND In a March 2015 VA examination, the Veteran reported that his neck symptoms started in 2014 after separation from service and he denied similar symptoms prior to 2014. In subsequent lay statements, he contends that his cervical spine disorder stemmed from an injury experienced in-service when his ship was hit broadside by a big wave, he was thrown across the deck, and his neck was severely wrenched. In light of the new statements attributing his cervical spine disorder to service, the Veteran should be afforded another examination to determine the nature and etiology of any currently present cervical spine disorder, to specifically include whether his current cervical spinal stenosis is related to service. The matter is REMANDED for the following actions: 1. Identify and obtain any pertinent, outstanding VA and private treatment records not already of record in the claims file. 2. Schedule the Veteran for an examination to determine the nature and etiology of any current cervical spine disorder. The claims file must be made available to, and reviewed by, the examiner. All indicated studies should be performed. Based on the examination results and review of the record, the examiner should provide an opinion as to whether it is at least as likely as not (a 50 percent probability or greater) that the Veteran’s cervical spine disorder is related to his active service. In forming the opinions, the examiner should address the Veteran’s July 2015 and June 2016 lay statements. The rationale for all opinions should be provided. 3. Then, readjudicate the claim on appeal. If the decision is adverse to the Veteran, issue a supplemental statement of the case to the Veteran and his representative and allow the appropriate time for response.
