Compensation under 38 U.S.C.1151 for hyperkalemia, due to rhabdomyolysis, is remanded. REASONS FOR REMAND The Veteran served on active duty from September 1955 to December 1961. He died in July 2013. The appellant is his substituted spouse. The appellant had a hearing before the undersigned Veterans Law Judge in October 2017. Service connection and compensation under 38 U.S.C.1151 claims for rhabdomyolysis with acute pigment nephropathy, as well as, for hyperkalemia related to rhabdomyolysis are remanded. In September 2018, the appellant submitted additional lay argument in support of her claims. At that time, she specifically indicated that she did not waive RO consideration of such evidence and requested remand of he claims for RO review. As such, these issues are remanded for RO review. The matters are REMANDED for the following action: The case should again be reviewed by the RO based on all the additional evidence received since the last supplemental statement of the case – to specifically include the appellant’s September 2018 argument. If the benefit sought is not granted, the RO should furnish the appellant a SSOC and a reasonable opportunity to respond before returning the record to the Board for further review. H.M.
