Entitlement to an effective date prior the August 30, 2010 for the grant of service connection for posttraumatic stress disorder is dismissed. FINDING OF FACT In January 2018, prior to the promulgation of a decision in the appeal, the Veteran withdrew the appeal of the claim for entitlement to an increased rating and earlier effective date for service connection posttraumatic stress disorder (PTSD). CONCLUSION OF LAW The criteria for withdrawal of a substantive appeal of the claims for entitlement an increased rating and earlier effective date for PTSD have been met. 38 U.S.C. § 7105 (b)(2);38 C.F.R. §§ 20.202, 20.204. REASONS AND BASES FOR FINDINGS AND CONCLUSIONS The Veteran served on active duty from September 1969 to January 1970, and from March 1972 to June 1972. In a January 2018 statement submitted to the Board, the Veteran, via his representative, expressed his desire to withdraw from appellate review his claims for entitlement to an increased rating and to an earlier effective date for PTSD. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. A substantive appeal may be withdrawn in writing at any time before the Board promulgates a decision. 38 C.F.R §§ 20.202, 20.204(b). Withdrawal may be made by the Veteran or the authorized representative. 38 C.F.R. § 20.204 (c). As a result of the Veteran’s withdrawal of his appeal as to the claims of entitlement to an increase rating and earlier effective for PTSD, no allegation of error of fact or law remains before the Board for consideration as to these issues. Therefore, the Board does not have jurisdiction to review the appeal as to these issues, and the claims are dismissed. MATTHEW W.
