Citation Nr: 18142556 Decision Date: 10/17/18 Archive Date: 10/16/18 DOCKET NO. 16-29 705 DATE: October 17, 2018 ORDER The appeal as to the issue of entitlement to an initial evaluation in excess of 70 percent for posttraumatic stress disorder (PTSD) with alcohol use disorder is dismissed. FINDING OF FACT In September 2016, prior to the promulgation of a decision in the appeal, the Veteran indicated in writing that he wanted to withdraw his appeal. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran have been met. 38 U.S.C. § 7105 (b)(2), (d)(5) (2012); 38 C.F.R. § 20.204 (2017). REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from March 1992 to January 1996, from January 2002 to January 2005, and from January 2006 to April 2006. This case comes before the Board of Veterans’ Appeals (Board) on appeal from a November 2014 rating decision of the Department of Veterans Affairs (VA) Regional Office (RO). In that decision, the RO granted service connection for PTSD with alcohol use disorder and assigned a 50 percent evaluation effective from December 8, 2012. During the pendency of the appeal, in a September 2016 rating decision, the RO increased the evaluation to 70 percent effective from December 18, 2012. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105 (2012). An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204 (2017). Withdrawal may be made by the appellant or his authorized representative. Id. In September 2016, following the decision by the RO to increase the evaluation for PTSD to 70 percent, the Veteran submitted a letter stating that he was satisfied with that decision and wished to withdraw his appeal. Thus, there remain no allegations of errors of fact or law for appellate consideration with respect to these claims.
