Citation Nr: 18142974 Decision Date: 10/18/18 Archive Date: 10/17/18 DOCKET NO. 16-15 789A DATE: October 18, 2018 REMANDED Entitlement to a rating in excess of 50 percent for posttraumatic stress disorder (PTSD) prior to November 30, 2017, is remanded. REASONS FOR REMAND The Veteran served honorably in the United States Marine Corps from March 1966 to February 1969. This matter comes before the Board of Veterans’ Appeals (Board) on appeal from a May 2015 rating decision of the Department of Veterans Affairs. This claim must be remanded for reissuance of the December 15, 2017, Supplemental Statement of the Case (SSOC) because the VA sent the SSOC to the wrong address and the notice was returned as undeliverable. Compare Notification Letter (Dec. 21, 2017) with VA Form 21-572, Request for Change of Address (stating that the Veteran’s new address) (emphasis added). Although the Veteran’s representative subsequently submitted a VA Form 646, Statement of Accredited Representative in Appealed case, there is no indication that the Veteran was aware of the December 2017 SSOC and he must be afforded due process as mandated by law. Therefore, this case is remanded for reissuance of the SSOC. The matter is REMANDED for the following action: 1. Send the Veteran and his representative the December 15, 2017, Supplemental Statement of the Case (SSOC), and provide an opportunity to respond.
