Citation Nr: 18143961 Decision Date: 10/23/18 Archive Date: 10/22/18 DOCKET NO. 18-15 702 DATE: October 23, 2018 ORDER The appeal regarding entitlement to an initial disability rating greater than 70 percent for posttraumatic stress disorder (PTSD) is dismissed. The appeal regarding entitlement to a total disability rating based on individual unemployability (TDIU) is dismissed. FINDINGS OF FACT 1. On June 26, 2018, prior to the promulgation of a decision in the appeal, the Board received notification from the Veteran that she wished to withdraw her appeal as to the rating assigned for PTSD. 2. On September 13, 2018, prior to the promulgation of a decision in the appeal, the Board received notification from the Veteran that she wished to withdraw her appeal as to TDIU. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran has been met. 38 U.S.C. § 7105 (2012); 38 C.F.R. § 20.204 (2017). REASONS AND BASES FOR FINDINGS AND CONCLUSION The Veteran served on active duty from May 1992 to January 1995. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the Veteran or by his or her authorized representative. 38 C.F.R. § 20.204. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. In the present case, the Veteran withdrew her appeal as to the PTSD initial increased rating claim in a June 26, 2018 letter. In a September 13, 2018 letter, the Veteran’s representative reiterated the Veteran’s withdrawal of that issue and withdrew “the incorporation of IU into the pending appeal.” See September 13, 2018 letter. Accordingly, the Board does not have jurisdiction to review the appeal, and it is dismissed. Here, Hence, there remain no allegations of errors of fact or law for appellate consideration.
