Citation Nr: 18144019 Decision Date: 10/22/18 Archive Date: 10/22/18 DOCKET NO. 14-19 853A DATE: October 22, 2018 ORDER The appeal as to the issues of service connection for a cervical spine disability with radiculopathy, sinusitis, hyperhidrosis, and muscle spasms is dismissed. FINDING OF FACT In August 2017, prior to the promulgation of a Board decision, VA received explicit notification from the Veteran indicating that she wished to withdraw from appellate review the issues of service connection for a cervical spine disability with radiculopathy, sinusitis, hyperhidrosis, and muscle spasms. CONCLUSIONS OF LAW 1. The criteria for withdrawal of the appeal as to the issue of service connection for a cervical spine disability with radiculopathy have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.204. 2. The criteria for withdrawal of the appeal as to the issue of service connection for sinusitis have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.204. 3. The criteria for withdrawal of the appeal as to the issue of service connection for hyperhidrosis have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.204. 4. The criteria for withdrawal of the appeal as to the issue of service connection for muscle spasms have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSIONS The Veteran served on active duty from June 1979 to June 1992, including service in the Southwest Asia theater of operations. These matters are before the Board of Veterans’ Appeals (Board) on appeal from a March 2012 rating decision of the Department of Veterans Affairs (VA) Regional Office (RO) in Montgomery, Alabama. Withdrawal of Issues on Appeal The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by a claimant or by his or her authorized representative. 38 C.F.R. § 20.204. (Continued on the next page)   In the instant case, VA received several statements by the Veteran and her representative in August 2017 indicating that she wanted to withdraw from appeal the issues of service connection for a cervical spine disability with radiculopathy, sinusitis, hyperhidrosis, and muscle spasms. As a result, there remain no allegations of errors of fact or law for appellate consideration of these issues.
