FINDING OF FACT The Veteran died in September 2018, prior to the Board’s promulgation of a decision on his claims perfected for appeal. CONCLUSIONS OF LAW Due to the death of the Veteran, the Board has no jurisdiction to adjudicate the merits of this appeal at this time. 38 U.S.C. § 7104(a); 38 C.F.R. § 20.1302. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty in the United States Army from October 1965 to October 1968. These matters come before the Board of Veterans’ Appeals (Board) on appeal from September 2012 (erectile dysfunction) and November 2014 rating decisions by the Department of Veterans Affairs (VA) Regional Office (RO). The Veteran died in September 2018, during the pendency of this appeal and prior to the Board’s promulgation of a decision of the issues currently on appeal. As a matter of law, appellants’ claims do not survive their deaths. See 38 U.S.C. § 7104(a); 38 C.F.R. § 20.1302. Accordingly, the appeal on the merits has become moot by virtue of the death of the appellant and must be dismissed for lack of jurisdiction. Id. In reaching this determination, the Board intimates no opinion as to the merits of this appeal or to any derivative claim brought by a survivor of the appellant. 38 C.F.R. § 20.1106. S.
