Citation Nr: 18144896 Decision Date: 10/25/18 Archive Date: 10/25/18 DOCKET NO. 14-40 922 DATE: October 25, 2018 ORDER The appeal of the issue of entitlement to payment or reimbursement for unauthorized medical expenses incurred on June 13, 2014, at Palm Bay Hospital is dismissed. FINDING OF FACT In September 2018, prior to the promulgation of a decision in the appeal, the Board received notification from the appellant, through his authorized representative, that a withdrawal of this appeal was requested. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the appellant through his authorized representative, for the issue of entitlement to payment or reimbursement for unauthorized medical expenses incurred on June 13, 2014, at Palm Bay Hospital are met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active duty service from February 1969 to July 1972, July 1987 to June 1988, November 2002 to November 2003, and September 2008 through April 2011. This matter comes before the Board of Veterans’ Appeals (Board) on appeal from a July 2014 letter of determination by a Department of Veterans Affairs (VA) Medical Center. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In the present case, the Veteran, through his authorized representative, in a September 2018 correspondence stated that he withdrew his appeal for medical reimbursement. As he has withdrawn this appeal, there remain no allegations of errors of fact or law for appellate consideration.
