FINDING OF FACT In April 2018, at a hearing before a Veterans Law Judge and prior to the adjudication of the issue on appeal, the Veteran provided in person his desire to withdraw the issue of entitlement to special monthly pension. CONCLUSION OF LAW The criteria for withdrawal of an appeal for entitlement to a special monthly pension by the Veteran have been met. 38 U.S.C. § 7105 (b)(2), (d)(5) (2012); 38 C.F.R. § 20.204 (2017). REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active service from October 1944 to July 1946. This case comes before the Board of Veterans’ Appeals (Board) on appeal from a rating decision of the Regional Office (RO). The Veteran was provided a hearing via live video teleconference before the undersigned Veterans Law Judge. A copy of the transcript has been associated with the record and reviewed accordingly. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105 (2012). An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204 (2017). Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In the present case, the Veteran, through an in-person appearance before the undersigned Veterans Law Judge, has withdrawn this appeal and, hence, there remain no allegations of errors of fact or law for appellate consideration. The Veteran was represented by an accredited representative at the time the withdraw was reported and it is assumed the representative informed the Veteran of the consequences of withdrawing his claim.
