Citation Nr: 18147960 Decision Date: 11/06/18 Archive Date: 11/06/18 DOCKET NO. 06-10 531 DATE: November 6, 2018 REMANDED Entitlement to service connection for residuals of a right great toe injury is remanded. REASONS FOR REMAND The Veteran had active duty from September 1969 to May 1971. In a February 2017 decision, the Board denied service connection for residuals of a right great toe injury. The Veteran appealed the decision to the Court of Appeals for Veterans Claims (Court). In a June 2018 order, the Court remanded the claim for additional development consistent with the parties’ May 2018 joint motion for remand (JMR). 1. Entitlement to service connection for residuals of a right great toe injury is remanded. Pursuant to the May 2018 JMR, the claim is remanded for a VA examination to determine the etiology of the Veteran’s current residuals of a right great toe injury. The matter is REMANDED for the following action: 1. Arrange for the Veteran to undergo a VA examination to determine the current nature and severity of his right toe disability. For each diagnosis, the examiner should issue medical opinions as to whether it is at least as likely as not (50 percent probability or higher) the condition had its onset in service or is related to service. The examiner is asked to explain the reasons behind any opinions expressed and conclusions reached. In addressing this question, the examiner is advised that in-service injury to the Veteran’s right big toe is established as credible by virtue of the combat presumption, despite no documentation of the same. 2. Readjudicate the appeal. R. FEINBERG Veterans Law Judge Board of Veterans’ Appeals ATTORNEY FOR THE BOARD J.A. Williams, Associate Counsel
