FINDINGS OF FACT 1. The Veteran served on active duty from November 1965 to August 1967 and from September 1972 to April 1991. He died in February 2006; the appellant is his surviving spouse. 2. In an October 2018 written statement, prior to the promulgation of a decision in the appeal, the Board received notification from the appellant of her desire to withdraw her appeal. CONCLUSION OF LAW The criteria for withdrawal of a substantive appeal by the appellant have been met. 38 U.S.C. § 7105 (b)(2), (d)(5) (2012); 38 C.F.R. §§ 20.202, 20.204 (2018). REASONS AND BASES FOR FINDINGS AND CONCLUSION While the appellant requested a Board hearing in her June 2015 VA Form 9, in an October 2018 written statement, she indicated she would not be attending the scheduled hearing. As such, the hearing request is considered withdrawn. Under 38 U.S.C. § 7105, the Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. A substantive appeal may be withdrawn in writing at any time before the Board promulgates a decision. 38 C.F.R. § 20.202. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In an October 2018 written statement, the appellant withdrew her appeal. Such withdrawal is effective the date the notice was received by the Board. Accordingly, the Board does not have jurisdiction to review this appeal and it is dismissed. L.
