Citation Nr: 18149676 Decision Date: 11/13/18 Archive Date: 11/13/18 DOCKET NO. 16-22 541 DATE: November 13, 2018 REMAND Entitlement to a rating in excess of 20 percent for chondromalacia, left knee status post meniscectomy with instability (chondromalacia) for the period from April 1, 2014 through April 27, 2016 is remanded. Entitlement to a rating in excess of 30 percent for left knee total replacement for the period from June 1, 2017 is remanded. Entitlement to a compensable rating for surgical scars, left knee associated with chondromalacia, left knee status post meniscectomy with instability (left knee scars) is remanded. Entitlement to total disability based on unemployability (TDIU) is remanded. REASONS FOR REMAND The Veteran served on active duty from May 1978 to August 1990. This matter comes before the Board of Veterans' Appeals (Board) on appeal from a September 2014 rating decision of the Department of Veterans Affairs (VA) Regional Office (RO). Following the issuance of the August 2016 supplemental statement of the case (SSOC), the Veteran’s left knee was evaluated during an August 2017 VA examination. As the RO did not issue a SSOC following the addition of the August 2017 VA examination with the claims file, a remand is warranted. 38 C.F.R. § 19.31. Reasons for Remand: After reviewing the evidence of record following the August 2016 SSOC, readjudicate the claims on appeal and issue a SSOC. S.
