Citation Nr: 18149724 Decision Date: 11/13/18 Archive Date: 11/13/18 DOCKET NO. 16-45 904 DATE: November 13, 2018 REMANDED Entitlement to an increased evaluation in excess of 10 percent for service-connected fungus right foot is remanded. REASONS FOR REMAND The Veteran had active duty for training from April 1977 to October 1977, and had active duty from June 1988 to November 1990. The appeal comes before the Board of Veterans’ Appeals (Board) from a September 2014 rating decision by the Department of Veterans Affairs (VA) Regional Office (RO). Entitlement to an increased evaluation in excess of 10 percent for service-connected fungus right foot is remanded. Following the July 2016 Statement of the Case (SOC), additional relevant evidence has been associated with the Veteran’s claims file by the AOJ. This evidence includes the report of a July 2017 VA skin examination. This relevant evidence has not been considered by the AOJ and no waiver of initial AOJ consideration of the evidence has been received. See 38 C.F.R. § 20.1304 (c) (2017). Hence, the Board is also required to remand the issue for issuance of the necessary Supplemental Statement of the Case (SSOC). The matter is REMANDED for the following action: 1. Obtain any outstanding and relevant VA and/or private treatment records. Should such exist, associate them with the Veteran’s electronic claims file. 2. Thereafter, after the above development and any additionally development deemed necessary, readjudicate the remaining issue on appeal. If the benefit sought on appeal remains denied, send the Veteran and her representative an SSOC that considers all additional relevant evidence (including the July 2017 VA skin examination and all additional relevant evidence received since the July 2016 SOC) and provide an opportunity to respond. If necessary, return the case to the Board for further appellate review. Michael Pappas Veterans Law Judge Board of Veterans’ Appeals ATTORNEY FOR THE BOARD J. Tunis, Associate Counsel
