Citation Nr: 18149836 Decision Date: 11/13/18 Archive Date: 11/13/18 DOCKET NO. 16-23 606 DATE: November 13, 2018 REMANDED Entitlement to service connection for sleep apnea is remanded. REASONS FOR REMAND The Veteran had active duty from October 1976 to January 1997. The Veteran submitted a Rapid Appeals Modernization Program (RAMP) Opt-in Election form in February 2018 selecting the option for “Supplemental Claim.” The issue adjudicated herein was a ctivated by the Board in December 2016. Because the appeal was activated by the Board prior to receiving the Veteran’s Opt-in form, the current claim is not eligible for RAMP processing. As such, the Board will continue with adjudication pursuant to current appeals procedures. 1. Entitlement to service connection for sleep apnea is remanded. After the claim was certified to the Board, the Veteran submitted additional evidence, including a January 2017 letter from family nurse practitioner, K.M.F regarding his sleep apnea. In a September 2018 letter, the Board asked the Veteran if he would waive agency of original jurisdiction (AOJ) consideration. In an October 2018 response, the Veteran requested that the claim be remanded back to the AOJ for review. Thus, a remand is required. See 38 C.F.R. §§ 19.37, 20.1304(c). The matter is REMANDED for the following action: Readjudicate the appeal. R. FEINBERG Veterans Law Judge Board of Veterans’ Appeals ATTORNEY FOR THE BOARD J.A. Williams, Associate Counsel
