FINDING OF FACT In October 2018, prior to the promulgation of a decision in the appeal, the Board received written notification from the Veteran indicating his intent to withdraw his appeal of the issue of entitlement to service connection for right knee strain with medullary bone infarct proximal diaphysis. CONCLUSION OF LAW The criteria for withdrawal of an appeal on the issue of entitlement to service connection for right knee strain with medullary bone infarct proximal diaphysis are met. 38 U.S.C. § 7105(b)(2), (d)(5) (2012); 38 C.F.R. § 20.204 (2017). REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from July 1973 to July 1978. This matter comes to the Board of Veterans’ Appeals (Board) on appeal from rating decisions of a Department of Veterans Affairs (VA) Regional Office (RO). The Board may dismiss any appeal that fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105(d)(5). An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the appellant or by his authorized representative. Id. In an October 2018 statement, the Veteran, through his representative, submitted a written request expressing his intent to withdraw his claim for service connection for right knee strain with medullary bone infarct proximal diaphysis. Accordingly, the Board does not have jurisdiction to review the instant appeal, and it is therefore dismissed. The Board notes that in October 2018, the Veteran requested a Board hearing by live video conference for his total disability individual unemployability due to service-connected disabilities (TDIU) claim.
