FINDING OF FACT In October 2018, prior to the promulgation of a decision in the appeal, the Board received written notification from the Veteran that a withdrawal of his appeal seeking service connection for hypertension was requested. CONCLUSION OF LAW The criteria for withdrawal of the appeal seeking service connection for hypertension are met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty with the United States Army from March 1968 to December 1969. This matter is before the Board of Veterans’ Appeals (Board) on appeal from a November 2011 rating decision of a Department of Veterans Affairs (VA) Regional Office (RO). This matter was previously before the Board in July 2017 when it was remanded for further development. Dismissed Appeal The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In the present case, in October 2018, VA received a written statement from the Veteran indicating that he wished to withdraw his appeal of the issue seeking service connection for hypertension. As the Veteran has knowingly and voluntarily withdrawn the appeal of the issue in accordance with 38 C.F.R. § 20.204, there remains no allegation of error of fact or law for the Board to address.
