Whether new and material has been received to reopen a claim of service connection for a low back disorder is remanded. Entitlement to a rating greater than 10 percent for residuals of a ruptured left eardrum is remanded. REASONS FOR REMAND The Veteran served on active duty from February 1979 to February 1983. This matter comes before the Board of Veterans' Appeals (Board) on appeal from a June 2012 rating decision of the Department of Veterans Affairs (VA). Remand is warranted to obtain a legal brief cited in a September 11, 2018 submission. Specifically, the Veteran's attorney noted that he was "submitting our Brief and any additional evidence we would like the Board to consider." The claims file contains a cover letter for the brief but not the brief itself. Additionally, the undersigned notes that the Veteran elected to have a videoconference hearing in his November 2016 VA Form 9. VA scheduled this hearing for April 17, 2017 in Indianapolis, Indiana. The Veteran contacted VA on February 15, 2017 to notify VA that he had relocated to Panama City Beach, Florida and that he desired to reschedule this hearing at a Regional Office closer to his new residence. VA did not attempt to reschedule the hearing. The Veteran changed representatives in April 2018, so it is unclear if he still desires to have this hearing. The legal brief cited above may address this issue, so the undersigned will instruct VA to clarify this on remand. The matters are REMANDED for the following action: 1. Ask the Veteran's attorney to resubmit the legal brief and any supporting evidence that he submitted with the September 11, 2018 letter. 2. Ask the Veteran's attorney to confirm whether the Veteran still desires the videoconference hearing the Veteran elected in his November 2016 VA Form 9. KELLI A.
