Citation Nr: 18150693 Decision Date: 11/16/18 Archive Date: 11/15/18 DOCKET NO. 16-44 246 DATE: November 16, 2018 REMANDED The issue of the propriety of withholding of compensation benefits to recoup disability severance pay is remanded. REASON FOR REMAND The Veteran served on active duty from July 2003 to December 2007. This matter comes to the Board of Veterans’ Appeals (Board) from an October 2015 administrative decision. In a May 2016 notice of disagreement and October 2016 VA Form 9 (Appeal to the Board of Veterans’ Appeals), the Veteran indicated that there may be outstanding and relevant bank statements in support of his claim. A remand is required to allow the Veteran to submit these records and any other financial records that may support his claim. The matter is REMANDED for the following actions: 1. Invite the Veteran to submit financial records in support of his claim, to include his bank statements (the Veteran is advised that he may redact the account number and/or other personal information on the submitted statements). 2. After completing the above, and any other development as may be indicated, the Veteran’s claim should be readjudicated based on the entirety of the evidence. If the claim remains denied, the Veteran and his representative should be issued a supplemental statement of the case. An appropriate period of time should be allowed for response. Thereafter, the case should be returned to the Board for further appellate consideration, if otherwise in order. ROMINA CASADEI Veterans Law Judge Board of Veterans’ Appeals ATTORNEY FOR THE BOARD S.
