Citation Nr: 18150829 Decision Date: 11/16/18 Archive Date: 11/15/18 DOCKET NO. 16-41 774 DATE: November 16, 2018 ORDER The appeal for an initial rating in excess of 10 percent for a left ankle sprain is dismissed. FINDING OF FACT On July 12, 2017, prior to the promulgation of a decision in the appeal, the Board received notification from the Veteran and his representative, that a withdrawal of his appeal for an increased initial rating for a left ankle strain, is requested. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran have been met as to the claim for an increased initial rating for a left ankle strain. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active service in the United States Navy from May 2002 to August 2013. This matter is before the Board of Veterans’ Appeals (Board) on appeal from a March 2014 rating decision. Withdrawal The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn in writing as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In a July 2017 email correspondence to his representative, the Veteran stated that he desired to formally withdraw his appeal as he is “satisfied with [his] recent 10% rating decision for [his] left ankle.” The Board finds this statement is explicit, unambiguous as it clearly states what is to be done, and shows and understanding of the consequences. DeLisio v. Shinseki, 25 Vet. App. 45,57, (2011). (CONTINUED ON THE NEXT PAGE)   In the present case, the Veteran has withdrawn his appeal for an increased initial rating for a left ankle strain, hence, there remain no allegations of errors of fact or law for appellate consideration as to that matter.
