Citation Nr: 18151142 Decision Date: 11/16/18 Archive Date: 11/16/18 DOCKET NO. 15-06 515 DATE: November 16, 2018 ORDER Entitlement to service connection for a low back disability is dismissed. Entitlement to service connection for a right knee disability is dismissed. Entitlement to service connection for bilateral hearing loss is dismissed. FINDING OF FACT On October 3, 2018, prior to the promulgation of a decision in the appeal, the Veteran, through his former representative, notified VA that he wished to withdraw his appeal. CONCLUSIONS OF LAW 1. The criteria for withdrawal of an appeal for service connection for a low back disability have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. 2. The criteria for withdrawal of an appeal for service connection for a right knee disability have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. 3. The criteria for withdrawal of an appeal for service connection for bilateral hearing loss have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSIONS The Veteran served on active duty from July 1976 to July 1979, and from October 2004 to October 2005. This matter is before the Board of Veterans’ Appeals (Board) on appeal from a January 2013 rating decision of the Department of Veterans Affairs (VA) Regional Office (RO). The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In the present case, the Veteran, through his appointed representative at that time, withdrew the appeal in an October 3, 2018, letter. The representative specifically noted that a withdrawal of the appeals under 38 C.F.R. § 20.204 was requested. Hence, there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal and it is dismissed. M. SORISIO Veterans Law Judge Board of Veterans’ Appeals ATTORNEY FOR THE BOARD K. Marenna, Counsel
