Citation Nr: 18151533 Decision Date: 11/19/18 Archive Date: 11/19/18 DOCKET NO. 13-18 310 DATE: November 19, 2018 ORDER Entitlement to a rating in excess of 10 percent prior to February 1, 2014 and for a compensable rating from February 1, 2014 for intervertebral disc syndrome of the right lower extremity is dismissed. FINDING OF FACT In September 2018, prior to the promulgation of a decision in the appeal, the Board of Veterans’ Appeals (Board) received notification from the Veteran through her authorized representative that a withdrawal of this appeal was requested. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from November 1977 to March 1978. This matter is before the Board of Veterans’ Appeals on appeal from a June 2011 rating decision of a Department of Veterans Affairs (VA) Regional Office (RO). The Board remanded the appeal for further development in June 2015 and July 2017. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the appellant or by her authorized representative. 38 C.F.R. § 20.204. In a September 2018 statement submitted by her authorized representative in a VA Form 21-4138, Statement in Support of Claim, the Veteran requested a withdrawal of her appeal. Accordingly, the Board no longer has jurisdiction to review the appeal, and this matter is dismissed. M. SORISIO Veterans Law Judge Board of Veterans’ Appeals ATTORNEY FOR THE BOARD M. H.
