REASONS FOR REMAND The Veteran served on active duty in the United States Army from May 1999 to August 1999, February 2003 to April 2004, and from January 2007 to July 2008. This matter comes before the Board of Veterans’ Appeals (Board) on appeal from a June 2012 rating decision of the Department of Veterans Affairs (VA) Regional Office (RO). In October 2018, the Veteran withdrew his request to appear at a hearing before a member of the Board. 38 C.F.R. § 20.704(e). 1. Entitlement to an initial rating in excess of 10 percent for psychomotor epilepsy is remanded. A review of the record indicates that the Veteran’s psychomotor epilepsy may have worsened since his last VA examination in August 2013. Specifically, available treatment records reflect that he had a major seizure in June 2014, and the August 2013 VA examiner indicated he had not had a major seizure in the last two years, and also was unable to assess whether he was currently having minor seizures. As such, a remand is necessary to afford the Veteran a contemporaneous VA examination to assess the current nature, extent and severity of his psychomotor epilepsy. See Snuffer v. Gober, 10 Vet. App. 400, 403 (1997). Any outstanding VA and private treatment records should also be secured. The matter is REMANDED for the following action: 1. Obtain all outstanding VA treatment records. 2. With any necessary assistance from the Veteran, obtain any outstanding relevant private treatment records. 3. Then schedule the Veteran for a VA examination to determine the current nature and severity of his psychomotor epilepsy. The claims file should be made available to and reviewed by the examiner and all necessary tests should be performed. All findings should be reported in detail. S.
