FINDING OF FACT 1. A February 2007 letter from the Veteran’s private psychiatrist, Dr. E.H. stated the Veteran suffers from hallucinations, has an impaired memory, experiences nightmares and flashbacks, and mood disturbances. 2. The May 2008 VA examination noted the Veteran worked as a school bus driver and reported forgetting to pick up or drop off the schoolchildren, forgetting bus stops, he failed to stop at a railroad crossing, and he became so angry with a hyperactive child that he “pinned him down.” He also reported difficulty with sleeping, concentration, an exaggerated startle response, irritability, and angry outbursts. 3. In an August 2008 statement, Dr. E.H. indicated that the Veteran’s PTSD symptoms consisted of nightmares, being easily startled, hypervigilance, rarely socializing with anyone (and limiting it to family members), severely impaired memory, anger, sadness, fear, hallucinations, illusions, depression, no energy, loss of interest, agitation, crying spells, and helplessness. 4. In his April 2009 Notice of Disagreement (NOD), the Veteran reported he had to quit his job as a bus driver due to his medications and anger. 5. Dr. E.H. wrote another letter received in January 2010, describing the Veteran’s symptoms. The Veteran suffered from nightmares, flashbacks, hypervigilance, memory impairment, mood disturbances, and hallucinations. 6. In his January 2010 formal appeal to the Board, the Veteran stated he was very guarded with people and his wife dressed him to ensure he was well groomed. He also reported having to stop work because he was at the point of hurting a child. The Veteran reported he did not like crowds or being around people, he had weekly nightmares and he had to work hard to manage his anger and hostility. CONCLUSION OF LAW Prior to November 28, 2012, the criteria for a disability rating of 100% have been met. 38 U.S.C. §§ 1155, 5107 (2012); 38 C.F.R. §§ 4.1, Diagnostic Code 9411 (2017).
