FINDING OF FACT In November 2018, after transfer of the file to the Board but prior to the promulgation of a Board decision, the Board received written notification from the appellant’s representative requesting a withdrawal of this appeal. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the appellant’s representative have been met. 38 U.S.C. 7105(b)(2), (d)(5) (2012); 38 C.F.R. 20.204 (2018). REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty in the U.S. Navy during peacetime from December 1976 to April 1977. This appeal proceeds from a July 2010 denial. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. 20.204. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. 20.204. The Veteran’s representative submitted a written request to withdraw his appeal in November 2018, after the case was the case was transferred to the Board. See 38 C.F.R. § 20.204(b)(3). There remain no allegations of errors of fact or law for appellate consideration, and the Board does not have jurisdiction to review the appeal.
