Citation Nr: 18152446 Decision Date: 11/21/18 Archive Date: 11/21/18 DOCKET NO. 15-15 689 DATE: November 21, 2018 REMANDED Entitlement to service connection for a left shoulder disability is remanded. Entitlement to service connection for bilateral hearing loss is remanded. Entitlement to service connection for asbestosis is remanded. Entitlement to service connection for sleep apnea is remanded. Entitlement to service connection for depression is remanded. REASONS FOR REMAND The Veteran had active service from August 1981 to July 1991. In July 2018, he testified at a Board hearing. Entitlement to service connection for a left shoulder disability, bilateral hearing loss, asbestosis, sleep apnea, and depression. In a Statement In Support Of Claim (VA Form 21-4138) received in July 2013, the Veteran indicated that he had been receiving medical treatment at the VA Medical Centers in Gainesville, Florida, and Jacksonville, Florida, from 2010 to the present. A review of the Veteran’s claims file reveals that VA outpatient treatment records dated prior to December 2010 and after January 2015 have not been obtained from any VA Medical Center. At his hearing, the Veteran requested that the record be kept open for 30 days so that additional medical records could be obtained and submitted. Any VA treatment records are within VA’s constructive possession, and are considered potentially relevant to the issues on appeal. Unfortunately, following the hearing, no additional records were received. A remand is required to allow VA to obtain them. The matters are REMANDED for the following action: Obtain the Veteran’s VA treatment records for the period from January 2010 to the present, to specifically include from the VA Medical Centers in Gainesville, Florida, and Jacksonville, Florida.
