Citation Nr: 18153086 Decision Date: 11/28/18 Archive Date: 11/27/18 DOCKET NO. 16-49 886A DATE: November 28, 2018 REMANDED An increased rating for chondromalacia of the left patella with degenerative joint disease, currently 20 percent, is remanded. REASONS FOR REMAND 1. An increased rating for chondromalacia of the left patella with degenerative joint disease, currently 20 percent, is remanded. While the Veteran was examined by VA for his left knee disability in February 2014, the examination report does not include joint testing for pain in passive motion or weight-bearing and nonweight-bearing. See 38 C.F.R. § 4.59 (2018); Correia v. McDonald, 28 Vet. App. 158 (2016). Thus, the Veteran should be afforded a new examination that includes such findings. The matter is REMANDED for the following actions: 1. Obtain any VA treatment records since October 2017. 2. Schedule the Veteran for a VA examination to determine the current severity of his left knee disability. The examiner should review the claims file and note that review in the report. The examiner should ensure that all indicated tests and studies are conducted, to include range of motion testing in active motion, passive motion, weight-bearing, and nonweight-bearing. In reporting the results of range of motion testing, the examiner should identify any objective evidence of pain. The examiner should set forth all objective findings, particularly the current severity of symptoms, and provide a complete rationale for all conclusions. 3. Then, readjudicate the claim with consideration of all of the evidence added to the claims file since the August 2016 statement of the case. If any decision remains adverse to the Veteran, issue a supplemental statement of the case and allow the appropriate time for response. Then, return the case to the Board. KELLI A.
