Citation Nr: 18153089 Decision Date: 11/27/18 Archive Date: 11/27/18 DOCKET NO. 15-24 012 DATE: November 27, 2018 ORDER The appeal seeking entitlement to increased rating higher than 10 percent for post-operative residuals of right shoulder dislocations with osteoarthritis is dismissed. FINDING OF FACT On an October 25, 2018 statement in support of claim, prior to the promulgation of a decision in the appeal, the Veteran indicated his desire to withdraw his appeal for entitlement to increased rating higher than 10 percent for post-operative residuals of right shoulder dislocations with osteoarthritis. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the appellant seeking entitlement to increased rating higher than 10 percent for post-operative residuals of right shoulder dislocations with osteoarthritis are met. 38 U.S.C. § 7105(b)(2), (d)(5) (2012); 38 C.F.R. § 20.204 (2017). REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from July 1979 to May 1983. In an October 2018 statement in support of claim, the Veteran, through his representative, indicated that he wished to cancel his scheduled November 2018 Board hearing and withdraw his appeal. Dismissal of Issue on Appeal (Continued on the next page)   The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105 (2012). An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204 (2017). Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In the present case, as discussed above, in an October 2018 statement in support of claim, the Veteran’s representative indicated that he wished to withdraw the pending issue of entitlement to increased rating higher than 10 percent for post-operative residuals of right shoulder dislocations with osteoarthritis. Hence, there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review this issue and the appeal is dismissed. S. B.
