Citation Nr: 18153662 Decision Date: 11/28/18 Archive Date: 11/28/18 DOCKET NO. 18-41 777 DATE: November 28, 2018 REMANDED Entitlement to an effective date prior to November 3, 2011, for an increased 20 percent rating for radiculopathy of the right lower extremity is remanded. REASONS FOR REMAND The Veteran served on active duty in the United States Army from February 1981 to February 2001. This matter comes before the Board of Veterans' Appeals (Board) on appeal from a November 2014 rating decision of a Department of Veterans Affairs (VA) Regional Office (RO). Entitlement to an effective date prior to November 3, 2011, for an increased 20 percent rating for radiculopathy of the right lower extremity is remanded. The Board notes that the Veteran has a pending claim for an increased rating for radiculopathy of the right lower extremity. The increased rating claim was last before the Board in May 2018; at which time it was remanded for further development, to include a VA examination. To date, the requested development has not been completed. Accordingly, the Board finds that the claim for an earlier effective date is intertwined with the claim for an increased evaluation, and therefore, must be remanded pending adjudication of the increased rating claim. The matter is REMANDED for the following action: 1. After adjudicating the Veteran's claim for an increased rating for radiculopathy of the right lower extremity, the AOJ must also readjudicate the Veteran's herein remanded claim for an earlier effective date prior to November 3, 2011, for an increased 20 percent rating for radiculopathy of the right lower extremity based on the entirety of the evidence.
