Entitlement to a total disability rating based on individual unemployability (TDIU) is remanded. REASONS FOR REMAND The Veteran had active service from February 1965 to November 1965. The Veteran had a videoconference hearing before the undersigned Veterans Law Judge in May 2015. In December 2015, the Board remanded this case in order to obtain updated medical records and to afford the Veteran with an examination to determine the nature and etiology of his left ulnar nerve disability. The matter of entitlement to a TDIU was also remanded due to the fact the claim is inextricably intertwined with the Veteran’s claim of service connection for his left ulnar nerve disability. The medical records and the examination were obtained and a supplemental statement of the case (SSOC) was issued in May 2016. Subsequent to the issuance of the SSOC, in August 2018, further relevant medical evidence was received. In an October 2018 correspondence, the Veteran clearly indicated he did not waive AOJ consideration of this new evidence. Therefore, remand for AOJ consideration of the additional evidence and issuance of an SSOC is necessary. The matters are REMANDED for the following action: 1. The AOJ should obtain any of the Veteran’s outstanding VA and private medical records and associate them with the claims file. If possible, the Veteran himself should submit any pertinent new evidence regarding the condition at issue in order to expedite the claim. 2. Readjudicate the issues on appeal. If the determinations remain adverse to the Veteran, he must be provided with a supplemental statement of the case. An appropriate period of time must then be allowed for a response before the record is returned to the Board for further review. John J.
