Citation Nr: 18154323 Decision Date: 11/29/18 Archive Date: 11/29/18 DOCKET NO. 16-18 204 DATE: November 29, 2018 ORDER The appeal for higher staged initial ratings for residuals of prostate cancer with voiding and erectile dysfunction, currently rated 100 percent from March 12, 2014 through August 31, 2015, 20 percent from September 1, 2015 through January 31, 2017, and 100 percent from February 1, 2017, is dismissed. FINDING OF FACT On February 9, 2017, and February 23, 2017, prior to the promulgation of a decision in this appeal, the Board received notification from the Veteran that a withdrawal of the appeal for higher staged initial ratings for residuals of prostate cancer with voiding and erectile dysfunction is requested. CONCLUSION OF LAW The criteria for withdrawal of the appeal by the Veteran for higher staged initial ratings for residuals of prostate cancer with voiding and erectile dysfunction have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served honorably in the United States Navy from September 1965 to August 1969. This matter comes before the Board of Veterans’ Appeals (Board) on appeal from an August 2015 rating decision of the Department of Veterans Affairs (VA). The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the Veteran or by his authorized representative. 38 C.F.R. § 20.204. In the present case, the Veteran twice submitted correspondence withdrawing this appeal, which was initiated by submission of a notice of disagreement on January 29, 2016. See correspondence received on February 9, 2017, and February 23, 2017. Since the Veteran withdrew his appeal, there remain no allegations of errors of fact or law for appellate consideration.
