This matter is on appeal from an August 2010 rating decision. The Veteran testified before the undersigned Veterans Law Judge in a videoconference hearing from the RO in May 2018. A transcript of the hearing has been associated with the claims file. Service connection for traumatic brain injury (TBI) is remanded. This claim is remanded for issuance of a supplemental statement of the case (SSOC). Additional relevant evidence was added to the record in June and July 2018. This was after the matter was last adjudicated by the RO in a September 2017 SSOC. Accordingly, the Board sent the Veteran a letter in August 2018 asking if she would like to waive initial RO consideration of this new evidence. The letter included a standard response form, which contained check boxes to elect (1) to have the case remanded and (2) to waive RO review of the evidence. The letter further informed her that if the Board did not hear from her, it would assume that she did not wish the Board to decide the appeal and would remand the case for RO review. (A courtesy copy was mailed to the Veteran’s representative in September 2018 because the August 2018 was not copied to the representative.) The Veteran did not respond to the Board’s letter. Thus, the Board will assume that she did not wish to waive RO consideration of this evidence. The matter is REMANDED for the following action: (Continued on the next page)   After considering new evidence since the September 2017 SSOC, if the claim is not granted in full, issue the Veteran a SSOC and return the case to the Board.
