Citation Nr: 18154825 Decision Date: 11/30/18 Archive Date: 11/30/18 DOCKET NO. 15-29 287 DATE: November 30, 2018 ORDER Entitlement to a disability rating in excess of 50 percent for service-connected posttraumatic stress disorder (PTSD) is dismissed from April 11, 2018 forward. FINDING OF FACT The Veteran withdrew his claim for a disability rating in excess of 50 percent for service-connected PTSD from April 11, 2018 forward. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran have been met as to the issue of a disability rating in excess of 50 percent for PTSD from April 11, 2018 forward. 38 U.S.C. § 7105; 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty for training from February 1985 to September 1985 and on active duty from August 2006 to January 2014. As a result of his service, the Veteran received the Combat Infantryman Badge among other decorations. This matter comes before the Board of Veterans’ Appeals (Board) from an August 2014 rating decision of the Department of Veterans Affairs (VA) Regional Office (RO). The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the appellant or by his authorized representative. 38 C.F.R. § 20.204. In the present case, the Veteran, through his representative, submitted a statement in support of claim on October 31, 2018. In this statement the Veteran stated, “I am satisfied with my 50 percent rating for PTSD and hereby withdraw my appeal” and it was signed by the Veteran. The Veteran is satisfied with his current rating and does not wish to seek an increase anymore. Hence, there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal as to this issue and it is dismissed.
