Citation Nr: 18154960 Decision Date: 12/04/18 Archive Date: 12/03/18 DOCKET NO. 14-03 299 DATE: December 4, 2018 REMANDED Entitlement to service connection for peripheral neuropathy is remanded. Entitlement to service connection for sacroiliitis is remanded. Entitlement to service connection for erectile dysfunction is remanded. Entitlement to service connection for urinary incontinence is remanded. REASONS FOR REMAND The Veteran served on active duty from April 2001 to September 2005. The Veteran filed a claim for peripheral neuropathy, claimed as radiculopathy, right leg, erectile dysfunction and urinary incontinence, in January 2010. He claimed all of these conditions were secondary to his service-connected lumbar spine disability. In April 2008, the Veteran added the claim of sacroiliitis. A rating decision was issued on all four claims in February 2011 and the Veteran filed a timely Notice of Disagreement (NOD) in April 2011. However, the RO never issued a Statement of the Case (SOC) addressing any of these issues. In January 2014, the RO issued an SOC in response to a prior Board remand. This SOC addressed the Veteran's claim for an increased rating for his service-connected lumbar spine disability. 1. Entitlement to service connection for peripheral neuropathy is remanded. Regarding the claim of entitlement to service connection for peripheral neuropathy, the Veteran submitted a timely notice of disagreement with a February 2011 rating decision, but a statement of the case has not yet been issued. A remand is required for the AOJ to issue a statement of the case. 38 C.F.R. § 20.200; Manlincon v. West, 12 Vet. App. 238, 240-41 (1999). 2. Entitlement to service connection for sacroiliitis is remanded. Regarding the claim of entitlement to service connection for sacroiliitis, the Veteran submitted a timely notice of disagreement with a February 2011 rating decision, but a statement of the case has not yet been issued. A remand is required for the AOJ to issue a statement of the case. 38 C.F.R. § 20.200; Manlincon v. West, 12 Vet. App. 238, 240-41 (1999). 3. Entitlement to service connection for erectile dysfunction is remanded. Regarding the claim of entitlement to service connection for erectile dysfunction, the Veteran submitted a timely notice of disagreement with a February 2011 rating decision, but a statement of the case has not yet been issued. A remand is required for the AOJ to issue a statement of the case. 38 C.F.R. § 20.200; Manlincon v. West, 12 Vet. App. 238, 240-41 (1999). 4. Entitlement to service connection for urinary incontinence is remanded. Regarding the claim of entitlement to service connection for urinary incontinence, the Veteran submitted a timely notice of disagreement with a February 2011 rating decision, but a statement of the case has not yet been issued. A remand is required for the AOJ to issue a statement of the case. 38 C.F.R. § 20.200; Manlincon v. West, 12 Vet. App. 238, 240-41 (1999). The matters are REMANDED for the following action: Send the Veteran and his representative a statement of the case that addresses the issues of entitlement to service connection for peripheral neuropathy, sacroiliitis, erectile dysfunction, and urinary incontinence. If the Veteran perfects an appeal by submitting a timely VA Form 9, the issues should be returned to the Board for further appellate consideration.
