Citation Nr: 18155290 Decision Date: 12/04/18 Archive Date: 12/03/18 DOCKET NO. 13-05 082 DATE: December 4, 2018 REMANDED Entitlement to a disability rating higher than 10 percent for service connected left foot chronic peroneal tendinitis is remanded. REASONS FOR REMAND In March 2015, and November 2017, the Board remanded the claim for additional development. Unfortunately, it is not clear if the last examiner specifically addressed the disability at issue. Therefore, another remand is required. Stegall v. West, 11 Vet. App. 268, 271 (1998). The matter is REMANDED for the following action: 1. Obtain any outstanding VA and/or private treatment records relevant to the claim on appeal. 2. Schedule the Veteran for an appropriate examination to determine the nature and severity of his service-connected left foot chronic peroneal tendinitis. All indicated tests and studies should be accomplished. In the report provided, the examiner should identify what foot conditions are associated with the service connected “chronic peroneal tendonitis,” (including e.g., left calcaneocuboid and talonavicular arthrodesis and/or ankle limitations), and if possible, attempt to distinguish the pain and limitations caused by each such condition. If it is not possible to make a distinction between impairment from service connected conditions and non-service connected conditions, that fact should be indicated. 3. Then, re-adjudicate the claim. If the benefit sought is not granted in full, issue the Veteran and his representative a supplemental statement of the case and return the appeal to the Board. M. E.
