Citation Nr: 18155490 Decision Date: 12/04/18 Archive Date: 12/04/18 DOCKET NO. 14-28 534 DATE: December 4, 2018 ORDER The appeal for an initial rating in excess of 30 percent for coronary artery disease (CAD) and unstable angina is dismissed. FINDING OF FACT On November 1, 2018, prior to the promulgation of a decision in the appeal, the Board received notification from the Veteran, through his authorized representative, requesting a withdrawal of the issue on appeal. CONCLUSION OF LAW The criteria for withdrawal of the appeal for entitlement to a rating in excess of 30 percent for CAD and unstable angina are met. 38 U.S.C. § 7105 (b)(2), (d)(5) (2012); 38 C.F.R. § 20.204 (2017). REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from August 1969 to March 1971. This matter comes before the Board of Veterans’ Appeals (Board) on appeal from an April 2013 rating decision issued by the Department of Veterans Affairs (VA) Regional Office (RO) in Houston, Texas. The current Agency of Jurisdiction (AOJ) is Nashville, Tennessee. The Veteran was scheduled for a Board hearing in October 2018. In September 2018, the Veteran requested the hearing be postponed and rescheduled. The hearing was rescheduled for November 2018. The Veteran subsequently withdrew his request for a Board hearing. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105 (2012). An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204 (2017). Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In the present case, the Veteran, through his representative, has withdrawn the appeal for an initial evaluation in excess of 30 percent for coronary artery disease. Hence, there remains no allegation of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal and it is dismissed.
