Citation Nr: 18156567 Decision Date: 12/10/18 Archive Date: 12/10/18 DOCKET NO. 16-43 317 DATE: December 10, 2018 REMANDED Whether a reduction in the rating for service-connected traumatic brain injury (TBI) from 40 percent disabling to noncompensable, effective February 1, 2013, was proper is remanded. REASONS FOR REMAND The Veteran served on active duty from August 2005 to August 2009. 1. Whether a reduction in the rating for service-connected traumatic brain injury (TBI) from 40 percent disabling to noncompensable, effective February 1, 2013, was proper is remanded. Regrettably, a remand is necessary. The claim was last adjudicated in a July 2016 statement of the case (SOC). After certification of the issue to the Board, the Veteran underwent a VA examination for his residuals of TBI in April 2018. Additional VA treatment records were also added to the record. A remand is necessary for the issuance of a SSOC addressing the additional evidence added to the file since the last adjudication of the claim. The matter is REMANDED for the following action: 1. Review the record and readjudicate the claim, to include whether reduction for TBI was proper. LESLEY A. REIN Veterans Law Judge Board of Veterans’ Appeals ATTORNEY FOR THE BOARD M.D.
